These General Terms and Conditions of Sale (hereinafter “GTCS”) are
concluded between GRIS and any person making a purchase on the Site (hereinafter
“the Customer”). Any purchase on the Site implies full and unreserved acceptance
of these GTCS.
ARTICLE 1 - DEFINITIONS
Customer: any User who proceeds with the purchase of a Product on
the Site and/or who has a personal account on the Site.
Order: the process by which the Customer selects the
Products they wish to purchase and have delivered. An Order is finalized
when the Customer has selected the Products and delivery options, and
paid the amount due.
Contract: these GTCS and, where applicable, the specific terms
and conditions applicable to certain promotional operations.
Personal data: all personal information relating to the Customer provided during the Order.
Parties: jointly GRIS and the Users of the Site.
Products: the products available for sale on the Site.
User: any natural or legal person accessing the Site,
whether a Customer or not.
ARTICLE 2 — PURPOSE AND VERSION IN FORCE
2.1. These GTCS define the conditions under which
Users access the Site, place Orders, as well as the rights and
obligations resulting therefrom.
2.2. Any User undertakes to comply with these GTCS,
whether they are visiting the Site or placing an Order. The GTCS are brought to their
attention for acceptance prior to any Order.
2.3. GRIS may modify these GTCS at any time, in particular to
take into account any legal, regulatory, or technical development. It is
recommended that the User consults them regularly.
2.4. The version applicable to an Order is the one in force on the date
the Order is placed. Each new Order requires the acceptance of the GTCS by the Customer.
2.5. The Customer must be a legal adult with full legal
capacity, or a duly represented legal entity. Failing that, they must have the
authorization of their legal representative.
ARTICLE 3 — PRICE
The prices displayed on the Site are indicated in euros, all taxes
included (TTC), excluding delivery charges. GRIS reserves the right to modify
its prices at any time; the prices applied are those displayed on the Site at the
time of the Order. Delivery charges are indicated separately before the
validation of the Order.
ARTICLE 4 — PRODUCT PRESENTATION
The Products offered are described and presented with the greatest possible
accuracy. The photographs illustrating the Products do not form part of the
contractual field; they are provided for information purposes and slight
variations (particularly in color) may exist due to technical display constraints.
For any additional information, the Customer may contact customer service at bonjour@gris-haircare.com.
ARTICLE 5 — ORDER
The User may browse the Site without any obligation to purchase. To
order, the Customer adds the Products of their choice to their cart, provides
the information necessary for delivery, and proceeds to payment.
Creating an account is not necessary to order: the Customer
may order as a "guest". The Customer undertakes to provide complete,
accurate, and up-to-date information.
Once the Order is finalized, GRIS confirms receipt by
sending an email to the address provided by the Customer. The Order is validated
once payment has been received in full. GRIS honors Orders within the limits of available stocks.
In the event of a Product becoming unavailable after an Order is placed, the Customer
will be informed by email and may choose to be refunded for the Product concerned or to have it delivered upon restocking.
ARTICLE 6 — DELIVERY
Delivery costs and times are indicated on the Site and reiterated
before the validation of the Order. Times are understood in working days
(excluding Saturdays, Sundays, and public holidays) and include preparation,
shipping, and transit.
In metropolitan France, the indicative delivery time is 3 to 6 working
days from the date of shipment. Delivery is free for purchases of €65 or more. Below this amount:
• Delivery to a relay point: €4.50
• Home delivery (UPS): €6.50
• Express 24h delivery (Chronopost): €9.90
Internationally: €9.90 in Europe (UPS Standard) and €19.90
outside Europe (UPS Express Saver). Times vary depending on the destination.
In the absence of a specified delivery time, GRIS undertakes to deliver within a
maximum period of thirty (30) days from the validation of the Order. As GRIS
uses third-party carriers, it cannot be held responsible for transit delays
attributable to them.
Risk transfers upon receipt of the Products by the
Customer. The Customer is invited to verify the conformity and condition of the package at
delivery; in the event of an anomaly, they are recommended to express reservations
to the carrier and to inform GRIS at bonjour@gris-haircare.com.
ARTICLE 7 — PAYMENT
Payment is made on the Site by credit card (Visa, Mastercard,
American Express) via Shopify Payments. Transactions are secured by the
payment provider. GRIS does not store any of the Customer's banking data and
cannot be held responsible for any malfunction occurring on the
payment platform, which is governed by the conditions specific to its provider.
ARTICLE 8 — RIGHT OF WITHDRAWAL
In accordance with articles L.221-18 et seq. of the Consumer Code,
the Customer has a period of fourteen (14) days from the receipt of their Order to exercise their right of withdrawal, without having
to justify their decision.
To exercise this right, the Customer must inform GRIS of their decision by email at
bonjour@gris-haircare.com, specifying the email address used for the Order and the
Product(s) concerned.
Exception specific to cosmetics. In accordance with article
L.221-28 3° of the Consumer Code, the right of withdrawal cannot be exercised for Products which, having been unsealed after delivery, cannot be
returned for reasons of hygiene or health protection. Consequently,
only unopened, unused Products in their original, intact packaging can be accepted for return.
A return fee of €3 is deducted from the refund. Returns are made at the Customer's risk;
it is advisable to opt for tracked shipping. The refund will be issued within fourteen (14) days from the recovery of the Products or proof of their shipment, using the payment method used during the Order.
For orders delivered outside the European Union, returns are not
possible due to customs constraints.
ARTICLE 9 — RETURN AND EXCHANGE
Beyond the legal right of withdrawal, GRIS offers as a commercial courtesy the
possibility of returning or exchanging a Product within fourteen (14) days of
receipt, under the same conditions (Product unopened, unused, in its original packaging). The request is made by
email to bonjour@gris-haircare.com specifying the email address of the Order
and the Product(s) concerned. The return costs (€3) are deducted from the
refund or store credit. This commercial policy does not restrict the legal
guarantees referred to in Article 13.
ARTICLE 10 — PERSONAL DATA
GRIS collects personal data when an Order is placed,
an account is created, or when subscribing to the newsletter (last name,
first name, email address, postal address, phone number). This data is
processed for the purposes of managing Orders, customer relations,
and, subject to the Customer's consent, commercial prospecting.
The data is only transmitted to service providers involved in
the execution of the Order (carriers, payment provider, host)
and is neither sold nor transferred to third parties for commercial purposes. It is
kept for the time necessary for the intended purposes, then archived
or deleted in accordance with legal obligations.
In accordance with Law No. 78-17 of January 6, 1978, as amended, and Regulation
(EU) 2016/679 (GDPR), the Customer has the right to access, rectify,
delete, port, limit, and object to the processing of their data.
These rights are exercised by email to bonjour@gris-haircare.com. The Customer may
also file a complaint with the CNIL (www.cnil.fr).
ARTICLE 11 — COOKIES
The Site uses cookies necessary for its operation as well as,
subject to the User's consent, audience measurement and personalization cookies.
The User can at any time configure or refuse cookies via the consent banner or their browser settings.
Cookies subject to consent are kept for a maximum duration of
thirteen (13) months.
ARTICLE 12 — INTELLECTUAL PROPERTY
The "GRIS" brand, its logos, its graphic charter, its texts,
visuals, and all content on the Site are the exclusive property of GRIS (SAS,
935 350 520 RCS Créteil) and are protected by intellectual property law.
Any total or partial reproduction or representation, without the prior written
authorization of GRIS, is prohibited. Browsing the
Site does not constitute any transfer of rights to the User.
ARTICLE 13 — LEGAL GUARANTEES
Independently of these GTCS, Products benefit from the legal
guarantee of conformity (articles L.217-3 et seq. of the Consumer Code)
and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code).
In this context, the Customer may obtain the replacement or refund of
non-conforming or defective Products, under the conditions provided by law.
Any complaint in this regard may be sent to bonjour@gris-haircare.com.
ARTICLE 14 — LIMITATION OF LIABILITY
GRIS undertakes to describe the Products accurately and to ensure their
compliance. The Customer undertakes to use the Products in accordance with their
instructions for use. The liability of GRIS cannot be engaged in the event of
non-compliant use, actions of a third party, fault of the Customer, or force
majeure within the meaning of Article 1218 of the Civil Code. In any event, only
direct and foreseeable damages are subject to compensation, within the
limit of the amount of the Order concerned. The Site is provided "as is";
GRIS endeavors to ensure its accessibility without guaranteeing uninterrupted availability.
ARTICLE 15 — COMPLAINTS AND CUSTOMER SERVICE
Any complaint or request for information regarding these GTCS
may be sent to customer service by email at bonjour@gris-haircare.com, from
Monday to Friday, 9 a.m. to 6 p.m. (excluding public holidays).
ARTICLE 16 — MEDIATION AND DISPUTE RESOLUTION
In accordance with articles L.611-1 et seq. and R.612-1 et seq. of the
Consumer Code, GRIS has implemented a consumer mediation mechanism.
In the event of a dispute, the Customer should first contact GRIS to
seek an amicable solution, by email at bonjour@gris-haircare.com. The
Customer must have previously submitted a written complaint. Failing a
satisfactory response within two (2) months, or in the event of a negative response,
the Customer may refer the matter free of charge to the consumer mediator
to which GRIS belongs:

ARTICLE 17 — MISCELLANEOUS PROVISIONS
17.1. Partial invalidity. If any provision of these GTCS
is declared void, the other provisions shall retain their full effect.
17.2. Non-waiver. The fact that one of the Parties does not
assert a breach shall not constitute a waiver for the future.
17.3. Applicable law. These GTCS are governed by French
law. In the absence of an amicable resolution, disputes shall be submitted to the competent
French courts.
